Breach of Contract

Breach of Contract Lawyer

When you enter into a business relationship, both sides make promises which constitute an enforceable contract. Breach of the contract can have devastating results for the injured party. It's always desirable for the parties to settle the dispute themselves, but sometimes litigation is unavoidable.

Breach-of-contract litigation is one of the core areas of Mr. Pu's practice. Richard Pu in New York City. For example, he has been extensively involved in representing debtors against lenders, franchisees against franchisors and garment importers against overseas suppliers or against banks that financed their operations.

Representing Your Interests

Which ever side of a breach-of-contract action you are on, Mr. Pu can give you excellent representation. Examples of agreements that sometimes result in breach of contract actions include:

  • Bank Loans
  • Partnership agreements
  • Shareholder agreements
  • Customer/broker actions
  • Securities

Mr. Pu handles every aspect of the litigation from beginning to end. He develops both the facts and the law, prepares pleadings, conducts discovery, makes motions, tries the case and, if need be, takes an appeal.

Mr. Pu also handles the enforcement of judgments. Business people tend to assume that once the judgment has been entered, the winner-- called the judgment creditor-- receives a check in the mail. But that doesn't always happen. Sometimes, the judgment creditor has to enforce the judgment by finding assets to sell. If the debtor has hidden assets, the judgment creditor may have to take discovery to locate them.  Sometimes, the judgment creditor has to enforce the judgment from the assets of related third parties, such as the shareholder of a defunct corporation. Mr. Pu represents both judgment creditors as well as judgment debtors, and is an expert at this phase of the litigation.

A solo practitioner like Mr. Pu has a natural advantage over a larger firm: the same person who read the case law also saw the documents and spoke to the witnesses. Mr. Pu knows from personal experience that at a larger firm, the left hand often doesn't know what the right hand is doing. And of course, a solo practitioner is more affordable, and the cost of the litigation frequently has a bearing on the outcome.

Consequences of Breach of Contract Litigation

If the plaintiff wins, the court will typically order the defendant to pay an amount of money which compensates the plaintiff for his injuries. In some cases, however, the court may award punitive damages--i.e., a penalty--which significantly increases the stakes for both sides. In other cases, the court may order the defendant to do something other than pay money--called "specific performance". In some situations, the court will order the defendant to pay the plaintiff's attorneys fees.
